1. Scope of Service

Elusive Rentals acts as a luxury yacht charter provider and booking platform. By booking a vessel through our website or third-party affiliates, the Client (the “Charterer”) agrees to abide by all maritime laws and company policies outlined herein.

2. Booking, Payments, and Security Deposits

  • Payment Schedule: A non-refundable deposit of 50% is required to secure any booking. The remaining balance must be paid in full no later than 72 hours prior to the scheduled departure. Failure to complete payment will result in an automatic cancellation and forfeiture of the deposit.

  • Security Deposit: For certain vessels or multi-day trips, a security “hold” may be placed on the Charterer’s credit card to cover potential incidental damages, excessive cleaning fees, or fuel surcharges.

  • Dynamic Pricing: Rates are subject to change based on seasonal demand, fuel fluctuations, and holiday surcharges unless a booking is already confirmed with a deposit.

3. Cancellation and Rescheduling Policy

  • Charterer Cancellation: * Cancellations made more than 14 days prior to departure will receive a full refund minus a 10% administrative fee.

    • Cancellations made between 7 and 14 days will receive a 50% refund.

    • Cancellations made less than 7 days prior to departure are strictly non-refundable.

  • Weather Cancellations: The Captain has the sole discretion to cancel a trip due to “Force Majeure” or unsafe sea conditions (e.g., Small Craft Advisories, lightning, or tropical storms). In such cases, the Charterer will be offered an alternative date or a 100% refund. Note: Overcast skies or light rain do not constitute grounds for a weather cancellation.

4. International Travel (Bimini & Bahamas Trips)

  • Documentation: For all trips crossing into international waters, all passengers MUST possess a valid Passport. Elusive Rentals is not responsible for any passenger denied entry by Bahamas Customs and Border Protection.

  • Customs Fees: Unless explicitly stated in the booking, the Charterer is responsible for all Bahamian entry fees, cruising permits, and dockage fees incurred during the stay.

5. Vessel Rules and Safety

  • Capacity: The number of passengers shall not exceed the vessel’s Coast Guard-certified capacity.

  • Illegal Substances: Elusive Rentals maintains a Zero Tolerance Policy for illegal drugs. Use of any federally prohibited substance will result in the immediate termination of the charter, return to the dock, and forfeiture of all payments.

  • Service Animals & Pets: Pets are strictly prohibited unless prior written consent is granted by the Company and a specific pet-cleaning fee is paid.

6. Liability and Indemnification

  • Assumption of Risk: The Charterer acknowledges that boating involves inherent risks. Elusive Rentals and its crew are not liable for personal injury, property loss, or motion sickness occurring during the charter.

  • Damage to Vessel: The Charterer agrees to be financially responsible for any damage to the yacht, its interior, or its equipment caused by the Charterer’s party’s negligence or willful misconduct.

7. Marketing and Media

Unless the Charterer explicitly requests privacy in writing, the Company reserves the right to use any photos or videos taken during the charter for promotional purposes on the Elusive Rentals website, Instagram, or YouTube.
